While filming in South Florida, approximately 24 members of a movie cast and crew experienced immediate and classic symptoms of food poisoning after they were served marlin fish for lunch. The movie production was interrupted and ultimately postponed. The insurer paid hundreds of thousands of dollars in Bi and lost profits. Kramer Green filed suit against the purveyor of the fish and the caterer at the movie set. By tracing the other marlin that had been sold to other buyers, Kramer Green was able to prove the same histamine poison levels existed in all the fish as a result of improper storage and obtained a Summary Judgment on liability in favor of the insurance carrier. Once liability was entered, the defense carrier ultimately settled the case for a confidential amount that was satisfactory to all concerned.
